همان کلوز C به علاوه تعدادی پوشش دیگر و در واقع حد وسط بین دو کلوز A و B است . این کلوز بجز بند های 4 ، 5 ، 6 ، 7 موارد استثنائات ، خسارتهایی را که منطقاً در ارتباط با یکی از موارد زیر باشد پوشش می دهد:

تمام خطرات تحت پوشش کلوز C
تلف یا آسیب وارده به کالای مورد بیمه که علت آن یکی از موارد ذیل باشد

2-1- فدا کردن کالا در جریان خسارت عمومی
2-2- به دریا انداختن کالا جهت سبک سازی کشتی یا به دریا افتادن کالا از روی عرشه کشتی
2-3- ورود آب دریا ، دریاچه یا رودخانه به کشتی ، شناور ، محفظه کالا ، کانتینر ، لیفت وان یا محل انبار

زلزله – آتشفشان یا صاعقه
4. تلف شدن کلی هربسته درکشتی یاشناور و یا تلف کلی هر بسته

لازم به ذکر است هم اکنون علاوه بر خطرات مندرج در فوق، خطرات :

کلوز ( ALL RISK ) A همان طرح تمام خطر و کاملترین و بهترین نوع بیمه بار یا همان بیمه باربری صادرات و واردات است که مورد پسند و انتخاب وارد کنندگان و صادر کنندگان مطرح قرار گرفته . این طرح کلیه خطرات به جزء بند های 4 ، 5 ، 6 موارد استثنائات را که موجب زیان و یا آسیب به مورد بیمه میگردد، تحت پوشش قرار می دهد آن هم با نرخ رقابتی و شرایط ایده آل که در تصویر مقایسه سه طرح اصلی می توانید پوشش های آن را مشاهده بفرمایید.

کلوز Total Loss

بیمه باربری صرفا با شرایط خسارت کلی یا تلف شدن کامل کالا را گویند.

در این طرح خسارت صرفا در صورت از بین رفتن کل کالا در یک مرحله در اثر آتش سوزی قابل پرداخت خواهد بود ؛ به همین دلیل به ندرت مورد درخواست بیمه گذاران قرار می گیرد .

استثنائات ( موارد خارج از پوشش بیمه های باربری واردات – صادرات )

1) تلف، آسیب یا هزینه ناشی از سوء عمل ارادی بیمه گذار

2) نشت و ریزش عادی، کسری عادی وزن یا حجم و یا فرسودگی و پوسیدگی عادی مورد بیمه

3) تلف ، آسیب یا هزینه ناشی از کافی نبودن یا نا مناسب بودن بسته بندی یا آماده سازی مورد بیمه برای حمل ((بسته بندی )) مندرج در این بند(4-3) شامل بارچینی در کانتینر و لیفت وان نیز می گردد، به شرط اینکه چنین عملی قبل از شروع بیمه کالا یا بوسیله بیمه گذار یا کارکنان وی انجام شده باشد.

4) تلف، آسیب یا هزینه ناشی از عیب ذاتی یا ماهیت مورد بیمه.

5) تلف، آسیب یا هزینه ای که علت اساسی آن تأخیر باشد، حتی اگر این تأخیر ناشی از خطرات بیمه شده باشد.

6) تلف، آسیب یا هزینه ناشی از ورشکستگی یا اعسار مالکان، مدیران، اجاره کنندگان یا گردانندگان کشتی یا قصور در انجام تعهدات مالی از طرف یکی از آنها .

7) آسیب عمدی یا تخریب عمدی کالای مورد بیمه یاقسمتی ازآن توأم باسوءنیت از طرف هرکس (فقط در کلوز A تحت پوشش می باشد).

8) تلف، آسیب یا هزینه ناشی از کاربرد هر نوع سلاح جنگی که با انرژی اتمی یا شکست و یا ترکیب هسته ای یا واکنش مشابه دیگر یا نیرو یا ماده رادیواکتیو کار کند.

9) استثناء مربوط به عدم قابلیت دریا نوردی و نامناسب بودن کشتی برای دریانوردی .

10) این بیمه به هیچ وجه زیان، آسیب یا هزینه ناشی از موارد زیر را پوشش نمی دهد:

10-1)عدم قابلیت دریانوردی کشتی یا کرجی

10-2) نامناسب بودن کشتی، کرجی، وسیله حمل، کانتینر یا لیفت وان جهت حمل سالم مورد بیمه، مشروط بر اینکه بیمه‌گذار یا کارکنان وی از چنین عدم قابلیت دریانوردی یا نامناسب بودن در زمان بارگیری کالای مورد بیمه در وسایط مذکور اطلاع داشته باشند.

11) استثناء خطر جنگ

از بین رفتن، آسیب دیدگی یا هزینه های ناشی از عوامل زیر به هیچ وجه تحت پوشش این بیمه نیست:

11-1) جنگ، جنگ داخلی، انقلاب، شورش، قیام و یا زد وخوردهای داخلی ناشی از این امور یا هر گونه عمل خصمانه توسط یا بر علیه یکی از دو قدرت متخاصم

11-2) توقیف، ضبط، مصادره، تصرف یا اثرات ناشی از این امور (به استثناء دزدی دریایی) یا اثرات ناشی از اقدام به شروع آنها.

11-3) مین، اژدر و بمبهای متروکه یا سایر سلاحهای جنگی به جا مانده و متروکه

12) استثناء خطر اعتصابات

این بیمه به هیچ وجه تلف، آسیب یا هزینه ناشی از موارد زیر را پوشش نمی دهد :

12-1)عمل اعتصاب کنندگان، جلوگیری ازورود کارگران یا عمل اشخاصی که در درگیریهای کارگری، آشوبها یااغتشاشات داخلی شرکت می کنند.

12-2) اعتصاب، تعطیل محل کار، درگیریهای کارگری، آشوبها و یا اغتشاشات داخلی

12-3) عمل هر تروریسم یا هر شخصی با انگیزه سیاسی

شرایط تشدید خطر و حق بیمه اضافي

در صورتیكه در بیمه نامه باربری وارداتي یا صادراتي، نوع وسیله نقلیه كشتي و یا كشتي همراه با وسائل نقلیه دیگر از قبیل كامیون یا قطار اعلام شود، شرط طبقه بندی كشتي مي بایست به بیمه نامه ضمیمه گردد، دراین شرایط كشتي های حامل كالا مي بایست توسط یكي از مؤسسات مندرج در شرایط ذكر شده طبقه بندی شده باشند.

منظور ازطبقه بندی شرایطي است كه كشتي های حامل كالا مي بایست دارا باشند و این شرایط معمولاً توسط مؤسسات معتبر بین المللي كه مورد قبول انستیتوی بیمه گران لندن مي باشند كنترل مي شود و به كشتي گواهي طبقه بندی اعطاء مي شود.

با شرایط زیر بیمه گذار مي بایست ضمن اعلام مراتب به بیمه گر حق بیمه اضافي متعلقه را پرداخت نماید.

چنانچه كشتي طبق شرایط مذكور طبقه بندی نشده باشد
سن كشتي بیش از حدودی باشد كه در شرایط ذكر شده
در صورت حمل محموله مورد بیمه با كشتي چاتر
كالابیمه شده بدون كانتینرروی عرشه كشتي حمل شود

روش پرداخت حق بیمه مربوط به بیمه باربری وارداتی و صادراتی صرفا نقدی است و به علت حساسیت بالای این رشته در تسویه حساب کامل قبل از شروع حرکت بار امکان پرداخت اقساطی وجود ندارد ؛ زیرا برای ارائه مدارک به بانک تامین کننده ارز میبایست رسید پرداخت کامل حق بیمه ، ممهور توسط واحد صدور به بانک تحویل داده شود .

شرایط تشدید خطر و حق بیمه اضافي

با شرایط زیر بیمه گذار مي بایست ضمن اعلام مراتب به بیمه گر حق بیمه اضافي متعلقه را پرداخت نماید.

چنانچه كشتي طبق شرایط مذكور طبقه بندی نشده باشد
سن كشتي بیش از حدودی باشد كه در شرایط ذكر شده
در صورت حمل محموله مورد بیمه با كشتي چاتر
كالابیمه شده بدون كانتینرروی عرشه كشتي حمل شود

بیمه ترانزیت | بیمه باربری ترانزیت سامان

مراحل لازم جهت پرداخت خسارت

1– اعلام وقوع حادثه :

بهتر است به محض وقوع حادثه در همان اولین روز کاری به سامینس یا نماینده صادر کننده بیمه نامه و همچنین به ستاد باربری بیمه سامان شرح واقعه را اعلام فرمایید.

3– تهیه مدارک لازم جهت بررسی خسارت :

4– حفظ حقوق بیمه گر در خصوص مورد بیمه اسیب دیده و حق جانشینی جهت بازیافت خسارت :

پس از مطالعه حق جانشینی مفهوم بند 4 برای شما آشکار خواهد شد :

تعریف حق جانشینی : حق جانشینی بیمه‌ گر یا همان بیمه سامان بر پایه اصل غرامت ( جبران خسارت ) استوار است كه بر اساس آن بیمه نباید برای بیمه‌گذار ( خریدار بیمه نامه ) منشاء سود واقع شود زیرا بیمه صرفا به جبران زیان به بار آمده می پردازد .
